TERMS AND CONDITIONS
I. Description of the Program
a) Each person with a Purchase Power account, an EasyPermitPostage® account or any other account to which the Program (as hereinafter defined) is extended (any such account being herein called an "Account") is automatically enrolled in the Purchase Power Rewards Program (the "Program"). Each person with an Account is herein called an "Accountholder".
b)Subject to clause (e) of this section I, Accountholders will earn points for purchases made through its Account at the rate of 2 points for each dollar spent, in the case of purchases made with a Purchase Power Visa® card (a Card"), and at the rate of 1 point for each dollar spent, in the case of all other purchases. Pitney Bowes will have the option to award additional points for purchases through an Account.
c)There will be an annual cap of 20,000 points that can be earned for purchases of postage (permit and meter postage combined).
d)Accrual of points will begin on the date as of which the Program is made effective for an Account.
e) Point earnings are based on the new net retail purchase transaction volume (i.e., purchases less credits, returns and adjustments) charged to the Account during each periodic billing cycle by the Accountholder ("Net Purchase(s)"). Net Purchases are rounded to the nearest dollar and are subject to verification. If a transaction is subject to a billing dispute, the points value of the transaction will be deducted from the points total during the dispute period. If the transaction is reinstated, points will be reinstated.
f) Points cannot be transferred from one Account to another. Points from multiple Accounts cannot be added together.
g) Points may not be combined with any other loyalty/frequency award program.
h) Points will not be earned or accumulated for finance charges, late fees, annual fees, over-limit fees, transaction fees or other charges to an Account other than for purchases.
i)Points are not the property of the Accountholder and cannot be bought, sold or transferred in any way (including upon death or as part of a domestic relations matter).
j) Points are tracked and redeemable on a first-in, first-out basis. Points will expire three (3) years from the date of issuance.
k)To earn points and to redeem points: the Account must be open (meaning not closed, canceled or terminated for any reason) and current (meaning there are no past-due balances on the Account); the outstanding balance on the Account must not be over the credit limit; the Account must not have a revoked, charged-off or bankruptcy status; and the Account cannot have any other status preventing authorizations.
l) The Accountholder agrees to release Pitney Bowes and any of its affiliates and Consumer Benefits Services, Inc. (the "Administrator") and its vendors from all liability for any injury, accident, loss, claim, expense or damages sustained by the Accountholder in connection with an award of points or use of points pursuant to the Program. The foregoing entities shall not be liable for consequential damages, and the sole extent of liability, if at all, shall not exceed the actual value of any reward pursuant to the Program.
m) The Accountholder is responsible for determining any tax liability arising from its participation in the Program. The Accountholder should consult a tax advisor concerning the tax consequences of its participation in the Program.
n) Pitney Bowes and the Administrator shall have no liability for disagreements between employees/representatives of an Accountholder as to the redemption of points. Discrepancies about points earnings are not treated as credit card billing disputes. Pitney Bowes' decisions regarding points discrepancies shall be final. Redeemed points are deducted from the Accountholder's points balance as of the request date of a reward.
o) Points can only be redeemed based on the points available as reflected on the Accountholder's most recent statement or last purchase cycle transmitted.
p)Except as described below in section IVa of these Terms and Conditions, points cannot be redeemed to offset any other of the Accountholder's obligations to Pitney Bowes.
q)Points must be redeemed by the Accountholder. PB and the Administrator are not responsible for redemptions made by individuals not authorized by the Accountholder to redeem.
r) Pitney Bowes reserves the right to disqualify any Accountholder from participation in the Program and invalidate all points for abuse, fraud or any violation of the Program terms and conditions. Pitney Bowes may make such a determination in its sole discretion.
s) The Program is void where prohibited by federal, state, or local law.
t)Pitney Bowes and the Administrator are not responsible for typographical errors and/or omissions in any Program document.
u) Pitney Bowes reserves the right to change these Terms and Conditions which govern the Program. At Pitney Bowes' option, redemption of points may be restricted, limited, expired or cancelled at any time without prior notice.
v) The Program is a service provided through the Administrator and Pitney Bowes. In the event of fraud, abuse of Program privileges or violation of the Program rules (including any attempt to sell, exchange or transfer points or the instrument exchangeable for points), Pitney Bowes reserves the right to cancel Accountholder's participation in the Program.
w) Eligibility to participate in the Program is restricted to Accountholders who have a statement address within any of the 50 States of the United States or within the District of Columbia.
II. Gift card Redemption Terms and Conditions
Gift cards are sent out via US Mail and will typically arrive within 2 weeks. Gift card vendors have their own individual terms and conditions that are not set by the Administrator or Pitney Bowes. Please see the back of the actual gift card for complete details. Pitney Bowes and the Administrator reserve the right to select and change gift card providers at their discretion.
III. Merchandise Awards Redemption Terms and Conditions
When necessary, the Administrator may substitute an award with an updated model of equal or greater value without advance notice. Accountholders will be notified of any change when ordering. The Administrator may remove certain items and may replace or remove certain sections within any Program literature or website. All awards are subject to availability. Merchandise awards will take four to six weeks to arrive from the time of order. Multiple awards may arrive at different times from different vendors. No shipments of merchandise can be made to APO/FPO or PO Box addresses. Merchandise shippable by UPS will be available to all US territories. Items being shipped to Alaska, Hawaii, Puerto Rico, and Guam will have an additional freight charge billed to the Accountholder's Account. Merchandise pictured in any Program catalog or website may not necessarily reflect exact colors or models of actual awards due to printing variations and/or manufacturers' updates. Information is accurate to the very best of our knowledge. Pitney Bowes and the Administrator are not responsible for errors or omissions. Points required for award items are subject to change. Accountholder may exchange merchandise only in the event of merchandise defects or damage in shipment. Any exceptions, damages, or shortages must be noted on the delivery receipt before Accountholder signs to accept shipment of merchandise. All merchandise is covered by manufacturer's warranties. Any such defect should be handled through the standard manufacturer repair facility as noted with product.
IV. REDEMPTION FOR POSTAGE AND SUPPLIES FROM PITNEY BOWES
a) Points earned as part of the Program can be redeemed at Pitney Bowes in the form of a credit that will be provided to the Accountholder in respect of an Account upon redemption by the Accountholder. Any such credits will be provided in accordance with the redemption schedule provided to the Accountholder in the Welcome Kit.
b) Pitney Bowes reserves the right in its sole discretion to amend the rules of the Program at any time.
